Each of the persons listed on and signing the Reservation Form (each a “Traveler”), via hard copy or by making a deposit via online submission, to join the tour referenced therein (the “Tour”) agrees that the services being provided by Viaggi di Gusto LLC (“VDG”) to him/her are subject to the following terms and conditions:

RESERVATIONS AND PAYMENT: Prices are based on double occupancy. A deposit per person specified on viaggidigusto.com is required to reserve space. Balance is due 60 days before departure. Credit card and online payments are subject to a 4% fee. Payments also can be made by check. If any required payment is not paid by the due date stated above, VDG will consider the trip cancelled by the Traveler(s) and no refund will be given.

BAGGAGE: All transportation will be provided by non-affiliated third-party suppliers. Due to limited motor coach capacity on the land portion of the Tour, transportation and porterage of only one suitcase and one carry-on per Traveler will be accepted. VDG assumes no liability for loss or damage to luggage.

TRAVELER CANCELLATIONS: All cancellations must be received in writing. For cancellations received within 60 days of deposit, a fee of $___ per person will be charged and the balance refunded. There is NO REFUND for cancellations received after 60 days of deposit or subsequent balance of payment. If Traveler has purchased a travel insurance policy, these cancellation charges might be reclaimable under such policy, depending on the reason for cancellation. Claims must be made directly to the insurance company concerned. Travel insurance policies and coverage varies by provider and policy. It is the responsibility of the Traveler to understand the terms of coverage.

PRICES: Rates are those in effect at the time of printing/website posting and are subject to change without notice due to increases in hotel and government taxes, currency exchange fluctuations, and other conditions. For certain Tours, rates are based on a required minimum number of Tour reservations. Not included in price of the Tour: airfare, expenses for obtaining passports or entry visas, meals and beverages other than those stated in the program, laundry, dry cleaning, toiletries, souvenirs, gratuities to driver and tour guides, or hotel/city taxes (typically between 2-6 euro per night per person and applied only in major cities/towns).

TRAVELER RESPONSIBILITIES: Travel insurance protection is strongly recommended and obtaining such insurance is the responsibility of Traveler solely. By declining travel protection, Traveler acknowledges and accepts liability for any cancellation penalties, damages and/or out–of-pocket expenses incurred. Traveler also acknowledges and accepts responsibility for arranging and paying for any treatment in case of a medical emergency while traveling.

Traveler assumes sole responsibility for obtaining and carrying valid passports, visas, vaccinations, and any other entry and/or travel documentation requirements of each destination. VDG accepts no liability or responsibility for any delay or expense incurred as a result of Traveler’s failure to comply with applicable documentation requirements, including but not limited to the requirement that Traveler procures, and has in his/her possession, the proper travel documents at all times. VDG recommends the Traveler consult with the appropriate domestic and foreign governmental agencies for the current document requirements.

Pregnant women are advised to consult their doctors before making any reservation, in order to confirm that it is appropriate for them participate in the Tour. Traveler agrees that VDG will not be liable for any damages arising from Traveler’s inability to participate in any or all of the Tour due to pregnancy, related illness, physical limitations or other health issues, and no compensation will be payable under such circumstances.

Traveler assumes all responsibility and costs in arranging travel to the Tour starting point, and from the Tour end point, in accordance with the Tour schedule provided by VDG. If Traveler arrives after the scheduled start of the Tour, Traveler assumes all responsibility and costs in arranging to join the in-progress Tour, and will not receive a partial or full refund for portions of the Tour that Traveler missed. The costs in this paragraph include, but are not limited to, Traveler’s airfare, ground transportation, and accommodations.

AGENT/INTERMEDIARY LIABILITY: VDG acts solely as an intermediary between the Traveler and the suppliers of transportation, accommodations, and other Tour operations (“Tour suppliers”). Accordingly, VDG’s liability is limited to the services VDG provides. VDG is not liable for delays, inconveniences, accidents, expenses or mishaps of any kind resulting entirely, or in part, from the negligence of others or from causes beyond the control of VDG or its employees, members, or managers. Because VDG does not maintain any supervision or control over personnel, equipment, or operations of suppliers, VDG, together with its employees, members, and managers, assumes no responsibility for and cannot be held liable for any personal injury, death, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned by reason of (i) any wrongful, negligent, willful, or unauthorized acts or omissions on the part of Tour suppliers, or their employees or agents; (ii) any defect in or failure of any vehicle, equipment, or instrument owned, operated or otherwise by any Tour supplier; or (iii) any wrongful, willful, or negligent act or omissions of any other party not under the direct supervision or control of VDG.

CHANGES AND CANCELLATION BY VDG: VDG reserves the right to modify the Tour itinerary upon short notice as a result of circumstances or events outside VDG’s control such as adverse weather or road conditions or any of those amounting to force majeure (defined below), or due to the operating conditions imposed by Tour suppliers. The Tour itinerary will, however, be the same in content as far as is reasonably possible, unless circumstances beyond VDG’s control make this impossible. No compensation will be payable for changes that are minor in nature and do not result in a material change to the Tour itinerary. Such minor changes include, but are not limited to, the substitution of restaurants or accommodations with those of a comparable or superior quality, or delays of two (2) hours or less for any activity included in the Tour, for any reason.

If a major change is made before the Tour start date, provided it does not arise from a force majeure event (defined below), the Traveler may choose (i) to accept the change; (ii) to cancel his/her reservation on such Tour and replace it with a future VDG tour of equal or greater value, at no additional cost to Traveler, within two (2) years from the date of such cancellation by Traveler; or (iii) to cancel his/her reservation and receive a full refund of all costs previously paid to VDG for such Tour. For purposes of these terms and conditions, a “major change” is defined as the removal of any town or city advertised as an overnight destination on the Tour, or the postponement or cancellation of the entire Tour by VDG.

If a major change is made during the Tour, VDG will pay each affected Traveler reasonable compensation depending on the circumstances, provided that if the major change is the result of a force majeure event (defined below), VDG is unable to refund, reimburse, or otherwise compensate Traveler (except to the extent VDG is able to obtain refunds from Tour suppliers).

Except where otherwise expressly stated in these terms and conditions, no compensation shall be paid for any changes or cancellations caused by “force majeure”, which is defined as any event which VDG or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include, whether actual or threatened, war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, significant risks to human health such as the outbreak of serious disease at the travel destination, pandemics, adverse weather conditions, fire and all similar events outside VDG’s control.

If VDG does not receive the minimum number of reservations required for the Tour (as applicable), it is permitted in its sole discretion to (i) cancel the Tour and provide Traveler with a full refund; or (ii) give Traveler the option to either pay an additional fee to remain on the Tour or to cancel his/her reservation and receive a full refund of all costs previously paid to VDG for such Tour. VDG will notify the Traveler of a cancellation for this reason no less than _____ days prior to departure.

VDG retains the right to refuse Traveler as a member of the Tour if, in VDG’s sole opinion, Traveler could endanger the health, safety and enjoyment of others on the Tour. In the event VDG exercises any of its rights in this paragraph, VDG’s sole liability and the Traveler’s sole remedy will be limited to a refund of any monies previously paid by Traveler to VDG, less the amount for services already paid for or performed, plus applicable administrative fees.

Traveler agrees to rely solely on these terms and conditions for any refunds Traveler desires. Traveler further agrees that he/she will not initiate a chargeback for any payment made to VDG by credit card (except in the case of actual fraud). Traveler shall be liable to VDG for all costs and losses VDG incurs as a result of such chargeback(s) initiated by Traveler in violation of this paragraph.

PHOTOGRAPHY/VIDEO DURING YOUR TRIP: VDG reserves the right to take photographs and videos of Traveler during the Tour and to use them for promotional purposes. By traveling with VDG, Traveler grants and conveys to VDG all right, title, and interest, including but not limited to, any royalties, proceeds, or other benefits, in any and all such photographs or recordings, and consents to the use by VDG of Traveler’s name, image, likeness, and voice in perpetuity, in any medium or format, without time or geographic limitations, for any publicity without further compensation or permission. This paragraph does not apply to any Traveler who is under 18 years old. If Traveler objects to this paragraph, he/she must inform VDG of such objection in writing prior to the Tour start date.

GOVERNING LAW AND VENUE: These terms and conditions are governed by Wisconsin state law and the venue of any dispute arising out of these terms and conditions or the services described herein shall be the state courts and federal district courts, as applicable, in Dane County, Wisconsin.
